The list only mentions examples of monsters that cannot be used. You can't use every single Toho kaiju, only those inaugurated into the roster. No Black Moth, no Minya, no GMK King Ghidorah, no Keizer Ghidorah. Obviously Titano can't list every single monster that cannot be used.

Your examples are monsters that have similar incarnations in the roster. Black Moth is a unique entity...a griffon. Unless I am unaware of another monster like him already on the roster...

Nowhere in the FAQ does it state this. The "rare exception to the rules" refers to the inclusion of EX-Gomora (a form of Gomora that Toho had no hand in) and the inclusion of the subtitle in Bagan vs. Everyone: Fallout.
